As of today, the federal government has entered a partial shutdown. While many immigration processes continue to operate, several key functions are disrupted.

Employers and foreign nationals should be aware of the following agency-specific impacts:

Department of Labor (DOL)

  • All DOL immigration functions are suspended.
  • LCAs, prevailing wage determinations, and PERM applications cannot be filed or processed.
  • This is the most significant impact for H-1B, PERM, and related cases.

USCIS

  • USCIS remains open and processing cases.
  • Petitions and applications can still be filed.
  • Some cases may be delayed if USCIS needs input from other closed agencies.

Department of State

  • Visa services continue while fee funding remains available.
  • Extended shutdowns could lead to delays or reduced services.

CBP

  • Border inspections and processing remain operational.
